2003 SPECIFICATIONS

SECTION 107

107.10 Claims (a) Unpaid Bills. Resident Engineers should advise individuals or businesses who desire to establish a claim against a Contractor for past due bills (that are related to a construction contract administered by the AHTD and owed to them) to notify the Chief Engineer in writing. This notification should include:

  • Name and address of claimant

  • State Job Number

  • Location of the work or Job Name

  • Contractor's Name

  • Service or materials provided and billed

  • Balance due

(When requested, the Resident Engineer should provide appropriate project identification information to the claimant.)

The Assistant Chief Engineer of Operations or another appropriate Department Official will reply in writing to the claimant, acknowledging receipt of the claim, and will provide copies to the Contractor, the Contractor's bonding company, and other interested parties. This letter places all parties involved on notice that a claim exists and that the Department does not adjudicate such claims.

107.11 Changes in Bridge Clearance. The Resident Engineer is to notify the District Bridge Inspector of impending construction that will alter a bridge clearance. Such notice must be given approximately two weeks in advance of the initiation of the work to insure that no permits are issued which would conflict with the revised clearance. The District Bridge Inspector will report the anticipated clearance to the Bridge Inventory Section. Upon completion of the work, the District Bridge Inspector will measure and report the final clearances.
