112.08 Rail Rehabilitation Projects. Rail rehabilitation projects usually involve rail upgrade, tie replacement, alignment, ballast, and switches. Since most railroad companies perform their own rail rehabilitation work, it is usually performed under a force account type of agreement with the railroad. The Resident Engineer is involved in the administration of these projects, but the field procedures for managing them deviate from "normal" field procedures. This is because the primary accountability for rail rehabilitation projects lies with the Department's Planning and Research Division. It is responsible for ensuring compliance with both the grant agreement signed with the Federal Railroad Administration (FRA) and the project agreement signed with the railroad. The Department's principal objective on this type of project is to administer and document grant expenditures in accordance with FRA grant agreement criteria.
The Intermodal Transportation Planner, AHTD Planning and Research Division, has the overall responsibility for the rail rehabilitation program. This includes:
Acting as liaison between the Planning and Research Division and the Department's Construction personnel,
Establishing any field procedures necessary for proper inspection and documentation,
Authorization of changes on rail rehabilitation projects, and
Authorization of payments to the Contractor.
The State Construction Engineer will transmit copies of the executed project agreement directly to the District and Resident Engineers, along with engineering charge

Issuance of the Work Order on rail rehabilitation projects will be requested by the Assistant Chief Engineer - Planning once all agreements have been executed and the Preconstruction Conference held. All requests and/or correspondence from the Contractor/Railroad concerning issuance of a Work Order or deviations from planned work shall be forwarded to the Planning and Research Division's Intermodal Transportation Planner.
The Resident Engineer's responsibilities on these projects include:
Setting up and conducting the Preconstruction Conference.
Advising the State Construction Engineer in writing of the start of work, with copies to the District Engineer, the Planning and Research Division, and the EEO Section. This letter should be patterned after Figure 108-1.
