be able to certify to the Congress that the State proposals have been constructed as originally proposed and approved, before such Federal Aid funds may be paid to the State.

The Resident Engineer should acquaint the FHWA with any anticipated Change Orders on Federal Oversight projects during visits by the FHWA Area Engineer. This will facilitate the handling of the change once it is submitted. All communication with the FHWA Division Office will normally be made by the Construction Office, except for project related matters involving the FHWA Area Engineer.

114.07 Relations with General Public. Each person should be treated with courtesy and respect in regard to business with the Department.

"Equal treatment of the individual with due regard for the protection of the public in general" is the criterion for the Department employee's relationship with the general public.

114.08 Relations with County and City Officials. Projects jointly financed by the FHWA and a County or City will have an agreement executed between the FHWA and the County or City in which both parties agree that the State Highway Department shall act as the agent of the County or City. The County's or City's representatives shall be accorded every courtesy in inspecting the work and in giving counsel to the Resident Engineer; however, the Resident Engineer is not obligated to accept and execute any suggestions given. In case of disagreement between the Resident Engineer and the representatives of the local governmental agency, the matter shall be referred to the District Engineer. The same general rule also applies to projects financed jointly by the State and the County or City.

114.09

Cooperation and Coordination with Central Office Construction
