Dear Judge Gaddis:

The Departmentof FacilityServices has reviewedthe Grand Jury's Narrative, Findingsand Recommendations regardingthe Burton Creek Sheriff's Substation and respectfullysubmits the following responses:

Burton Creek Facilitv Annual Inspection

FINDINGS:

The Grand Jury found that the Burton Creek Substation complies with the applicable Penal Code sections dealing with the processingand holding of persons in custody. As in past Grand Jury findings, Burton Creek continuesto be inefficientdue to inadequatefacilities. The building is not ADA compliant in the sense that it is inadequateto serve the public in a safe and effective manner. The Burton Creek facility has for many years been in need of a replacementdue to these deficiencies. Taxpayer money continuesto be wasted to patch or quick fix the problemsat this facility. We found overall that the management is doing the best they can with this facility to keep it maintainedand well managed.

RESPONSE: The Departmentpartiallydisagrees with this finding. While we agree with the Grand Jury's assessment that the facility is inadequate, the Departmentof Facility Services believesthis is due to the age and configuration of the building rather than attributableto issues related to safety. With regard to the Americans with DisabilitiesAct (ADA), this statute requiresthat services and programs are providedto the publicwithout regardto an individual's physical disabilities. A facet of the ADA does provide design standards, (e.g. slope, configurationsfor path of travel, counter accessibility, etc) however, the purposeof these requirementsis to ensure that physicalbarriersdo not impede access to programs that may be housedwithin a facility. The ADA does not address issues of safety and efficiency. Facility Services agrees this facility is in need of replacement and is taking actions to that end.
