These RESTRICTIVE COVENANTS, DECLARATION OF HOMEOWNER’S ASSOCIATION & ROAD MAINTENANCE AGREEMENT FOR “WHITE OAK PONDS SUBDIVISION” is amended this the 1st day of November, 2007 by the undersigned S & W DEVELOPERS, INC. (hereafter referred to as “Developer”) and George F. Bailey, ( owner of lots 17 & 18 ), representing 100% ownership in WHITE OAK PONDS SUBDIVISION.

WITNESSETH:

WHEREAS, Developer is the owner of that real property located in Fannin County, Georgia, described in Exhibit "A" attached hereto and made a part hereof (the "Property") and

WHEREAS, a plat and survey setting forth the individual, numbered lots is recorded in Plat Hanger                 pages                   in the Office of the Clerk of the Superior Court of Fannin County, Georgia, and incorporated herein by reference.
