PLANNING COMMISSION ACTION

Item No. 6: FP-10-05-03; final plat approval for BRITTANY RIDGE, 4th Plat, (21 Lots), located in the 7200 block of Woodland Drive, was approved as a consent agenda item, on page one.

REPEAT OF CONSENT AGENDA MOTION.

Commissioner Jenkins, seconded by Commissioner Bedora, moved that Consent Item 2, 3, 4, 5 6 7 & 8 be approved, subject to staff recommendations.  The motion carried 9-0.

FP-11-05-03: consider final plat approval for CYPRESS POINT VILLAS, 4th Plat, (10 Lots), located in the 7200 block of Legler Street.  Request submitted by Campbell, Barber, Lambeth & Associates for Smith/Waters Development Co., LLC, owner.

This was a consent item.

The applicant requests final plat approval for Cypress Pointe Villas, Fourth Plat, a replat of a portion of Heartland Villas, First Plat, a multi-family town home development generally located in the 7200 block of Legler Street.  The application is filed by Campbell, Barber, Lambeth and Associates for Smith/Waters Development Inc., owner.

RECOMMENDATION

Planning staff recommends approval of FP-11-05-03, Final Plat of Cypress Pointe Villas, Fourth Plat, generally located in the 7200 block of Legler Street, subject to the following conditions:

1.Acceptance of the dedications on the final plat by the Shawnee City Council and the recording of the final plat with the Johnson County Register of Deeds shall be completed prior to issuance of any building permits;

2.Recording of the plat and any Homes Association documents prior to the sale of the units;

3.This plat shall be limited to three town home buildings containing ten residential units on ten lots all contained on 1.61 acres;

4All bulk regulations of the PMR (Planned Mixed Residential) zoning district shall be met;

5.Telephone, electric and cable service facilities are to be placed within rear and side yards as required by Policy Statement PS-24.  All utilities shall be placed underground; and
