lengths of all lines, and the individual area, in square feet, of all lots, open space tracts, and right-of-ways, and the centerline miles of all newly dedicated streets.  The applicant is also advised the County Engineer does not yet require all points on a plat to be based on the Kansas State Plane Coordinates although this requirement may be implemented prior to preparing the final plat for this development or the recording copies of the final plat.

RECOMMENDATION

Staff recommends approval of PUD-1-05-03, rezoning from PMR (Planned Mixed Residential) to PMR (Planned Mixed Residential) and revised preliminary development plan approval for Lakepointe Tenth, a single-family and duplex residential subdivision, located in the 20900 block of 60th Terrace, subject to the following conditions:

1.The development shall be limited to 6 duplex units and 65 single-family units on 68 lots on 21.38 acres;

2.

Acceptance of the final plans and the dedications on the final plat by the Shawnee City Council and recording of the final plat with the Johnson County Register of Deeds shall be completed prior to the issuance of any building permits;

3.The provisions of the excise tax shall be satisfied prior to the Mayor signing the recording copies of the final plat;

4.Addendums to the Homes Association documents and the restrictions and covenants of ownership documents incorporating these lots into the documents previously recorded for the previously recorded plats shall be submitted with the application of the final plat;

5.All bulk regulations of the PMR zoning district shall be met;

6.The applicant shall be responsible for providing a detailed landscape plan for Tracts U and V, as well as the dedicated landscape easements along the rear of Lots 460-462.  The landscape plan shall be submitted with the final plat for this phase;

7.The landscaping shall be installed in conjunction with the public improvements for this phase;

8.No greater than twenty percent of the single family homes in the subdivision may be constructed with the same elevation;

9.The street improvements required for this development shall be designed according to the standards in the Shawnee Manual of Technical Specifications and Design Criteria, as identified in the staff report;
