20.The applicant is responsible for submitting a rough grading, and an erosion and siltation control plan with the street and storm drainage improvement plans;

21.Erosion and sediment control measures shall be installed and maintained, as identified in the staff report, until all construction is complete;

22.The applicant/homebuilder is responsible for submitting a Category II Plot Plan to the City in accordance with the “lot-to-lot” grading standards for each lot in the residential development prior to the issuance of any type of building permit;

23.The applicant is responsible for obtaining all such permits as may be required by all Federal, State, and Local agencies, including but not limited to the Kansas Department of Health and Environment (KDHE), Kansas Division of Water Resources (DWR), and U.S. Army Corps of Engineers (COE);

24.The applicant is responsible for scheduling a pre-design meeting with Engineering staff prior to preparing any public improvement plans.  Individual sets of the final street, storm drainage and stormwater detention, and street lighting plans must be submitted to the City for review and approval prior to commencing construction work on the site.  These plans shall be prepared according to the standards in the Shawnee Manual of Technical Specifications and Design Criteria;

25.Prior to commencing construction work, the applicant must obtain one or more Public Improvements Permit for all street, storm drainage and stormwater detention, and street lighting improvements required for the development site.  All public improvements shall be constructed according to the standards in the Shawnee Manual of Technical Specifications and Design Criteria.  No footing and foundation permits for the development shall be issued prior to the completion, inspection and acceptance of all required public improvements;

26.Open space fees in the amount of $300 per residential lot ($21,300) shall be paid prior to issuance of a building permit, as provided by SMC 12.14;

27.The Fire Chief shall approve all fire hydrant locations.  Any required hydrants shall be installed prior to issuance of a building permit; and

28.The applicant is responsible for submitting two (2) copies of the computation plat with the recording copies of the final plat.

PLANNING COMMISSION QUESTIONS

Lenny Mullin, 24725 W. 79th Street stated that he had diligently reviewed and was in agreement with all 28 conditions that staff recommends for this project.  He explained that the reason for the proposal was to change some of the duplex lots back to single family lots.
