Associate Planner Allmon explained that the applicant requests special use permit and site plan approval for construction of an 11,560 square foot church that will include a preschool, located in the 23900 block of 83rd Terrace. The application is filed by Fish Development on behalf of Crown Development, owner.
SPECIAL USE PERMIT REVIEW
1.The applicant requests a special use permit to allow operation of a preschool for up to 60 children at a church. The property is zoned PI (Planned Industrial). The preschool is proposed to operate from 8:30 a.m. to 3:30 p.m., Monday through Friday.
2.The new structure will be located at the western end of the 83rd Terrace cul-de-sac that will be constructed in conjunction with this development. Properties to the north, east, and south are zoned PI. The Shawnee/Lenexa corporate boundary abuts the west side of this property. The properties within Lenexa to the west are found in the Mac Acres Subdivision and contain the Church of the Rock. Vacant property found in lot 3 of the Perimeter Park 10th Plat borders the property to the south, and 83rd Street is adjacent to the north. Properties to the east and south are within the Perimeter Park Industrial Development. Two office/warehouse buildings were recently approved on the vacant property located directly to the south.
3.The property is a 2.24 acre (97,731 square foot) lot that is being platted as lot 2 of the Perimeter Park 10th Plat. The final plat shall be recorded at the Johnson County Records and Tax Administration Office prior to issuance of any building permit on the lot.
4.The Land Use Guide of the Comprehensive Plan designates warehouse/industrial uses as appropriate for this area. Churches are permitted in any zoning district by the Shawnee Municipal Code, and are afforded further zoning protection by the Religious Freedom and Land Use Act.
