Staff recommends approval of FP-10-05-03, Final Plat for Brittany Ridge, Fourth Plat, a single-family residential subdivision generally located in the 7200 Block of Woodland Drive, subject to the following conditions:

1.Acceptance of the dedications on the final plat by the Shawnee Governing Body and recording of the final plat with the Johnson County Register of Deeds shall be completed prior to the issuance of any building permits;

2.This phase of development shall be limited to 21 single-family lots on 8.60 acres;

3.The provisions of the excise tax shall be satisfied prior to the Mayor signing the recording copies of the final plat;

4.An addendum to the Homes Association documents, and the Restrictions and Covenants of Ownership documents that incorporate the lots of the new plat into the documents recorded with the Johnson County Register of Deeds office for the first plat, shall be submitted with the recording copies of the final plat for recording at the applicant’s expense;

5.All bulk regulations of the R-1 zoning district shall be met, including minimum lot size of 9,000 square feet, minimum front setback of 30 feet and minimum lot frontage of 75 feet;

6.The minimum home size shall be 1,800 for a single story ranch, 1,900 square feet for any 2 or 2½ story residence, and 2,100 square feet for any 1½ or tri-level residence, as indicated by the developer;

7.The developer shall take every precaution to preserve and protect as many of the existing trees as possible.  Prior to any clearing and grubbing, or grading on the site, the applicant shall place construction fencing around the trees not to be disturbed.  Construction fencing shall be placed as a minimum, at the tree canopy drip line.  The construction fencing shall remain in place throughout construction and to be removed only after Certificate of Occupancy has been issued for each lot;

8.The applicant shall submit a tree preservation plan for the area east of Carson Street prior to consideration of the final plat by the Governing Body.  Two copies of the plan shall be submitted to Planning staff prior to March 28, 2005 to remain on the April 11, 2005 agenda;

9.The street improvements required for this development shall be designed according to the standards in the Shawnee Manual of Technical Specifications and Design Criteria, and as identified in the staff report;

10.All internal streets shall be designed and improved in accordance with the standards for local residential streets;
