When the Commissioner decides that a site visit is necessary for any reason in conjunction with the processing of an application, he shall notify the applicant and a date shall be scheduled.
Once an application is complete, the Commissioner shall tentatively decide whether the permit should be issued or denied.
If the Commissioner tentatively decides the permit should be denied, he shall prepare a notice to deny. A notice of intent to deny the permit shall be sent to the applicant. The applicant may wish to appeal the Commissioner’s decision to the Board by filing a written petition as provided at TCA 68-211-113(b) of the Act.
If the Commissioner tentatively decides the permit should be issued, he shall prepare a draft permit as set forth in part 4 of this subparagraph.
A draft permit shall contain (either expressly or by reference) all applicable terms and conditions from paragraph (4) of this rule.
