RESERVATIONS

CHILE

The Permanent Mission of Chile to the United Nations presents its compliments to the Permanent Mission of the Republic of South Africa to the United Nations, in its capacity as Chairman of the Mid-Term Review Ministerial Conference of the Non-Aligned Movement held in Durban, South Africa from 17 - 19 August 2004, has the honour to submit the following reservations:

"The Government of Chile expresses its reservations with regard to those paragraphs whose contents may be considered contrary to the current policies and existing international obligations of the Republic of Chile".

The Permanent Mission of Chile to the United Nations avails itself of this opportunity to renew to the Permanent Mission the Republic of South Africa the assurances of its highest consideration.

The Ministry of Foreign Affairs of the Republic of Cuba presents its compliments to the Honorable Ministry of Foreign Affairs of the Republic of South Africa and has the honor to refer to the Final Document adopted by the XIV Ministerial Conference of the Non Aligned Movement, held in Durban, South Africa, on August 17th -19th, 2004.

The Ministry of Foreign Affairs of the Republic of Cuba would like, hereby, to make known its express reservation as to paragraphs 180 and 181 referred to Iraq, included in the afore-mentioned document adopted in Durban.

For Cuba, the so-called Interim Government of Iraq resulted from the invasion and occupation of the Iraqi territory by foreign powers, in violation of International Law and the UN Charter; therefore, it lacks the legitimacy provided by paragraph 180 of the Final Document agreed in Durban.

The Ministry of Foreign Affairs of the Republic of Cuba also considers that the resolutions outlined in paragraph 181 of the Final Declaration, reaffirm the subordinate nature of the so-called Interim Government of Iraq and involve the United Nations into a process that was neither approved nor accepted by that world Organization whatsoever.

The Ministry of Foreign Affairs of the Republic of Cuba would like to inform the Honorable Ministry of Foreign Affairs of South Africa that the Cuban delegation to the XIV Ministerial Conference did not raise any objection to the afore-mentioned paragraphs during the discussions held in Durban, with the aim of causing no additional problems to the successful culmination of the Conference and due to the existing time limitation.
