If a customer defaults on an arrangement then reminders and a court warning will be issued.  Arrangements can be amended or reset at this stage.  If the customer does not make an arrangement to pay the debt, or continually defaults on payment arrangements then legal proceedings will be instigated.

Before legal action is taken a check will be done to see if the customer is back in receipt of Housing Benefit.  If this is the case the invoice will be cancelled and the remaining debt recovered by deductions from ongoing Housing Benefit entitlement.

If the customer is querying the charge or details an invoice will be put on hold until these issues have been dealt with.

National Non-Domestic Rates Recovery Procedures

Customers will be encouraged to make early contact if they are having difficulties making payments.

Customers will be advised about Business Debtline if it becomes apparent that their business is experiencing difficulties because of business debts.

Sundry Debt Recovery Procedures

Payment in full is normally sought when a Sundry Debt invoice is issued.

Customers will be encouraged to make early contact if they are having difficulties making payments.

An arrangement to pay in instalments may be considered if the customer is experiencing financial difficulties.

Members of staff will also advise of the Corporate Debt officer if it becomes apparent during a conversation about an invoice that there are multiple debts to the Council involved.

Debtco

  Debtco can be seen as the final stage in the collection of sundry debts.  Its use is applicable to sundry debts only and is now an automated process at the top end of the IRAS system.  It does however require that the Service takes a specific decision to refer a debt to Debtco and to be prepared to produce the necessary justification for that debt.
