  • 3.

    Inspection of Books and Copying

    • Shareholders may inspect the books and records of the Fund relating to the shareholders at the offices of the asset manager, the distributor or the Authorized Participant during business hours and request (certified) copies thereof, which the asset manager, the distributor or the Authorized Participant may not refuse without due reasons.

  • The shareholders may inspect and copy the following books and records: ¾ Statement of Fund assets ¾ Register of net asset value per share of the Fund ¾ Financial statement and ancillary documents ¾ Transaction statements.

    • 4.

      Liability for Damages

  • If the asset manager has committed an act in violation of the laws, the trust deed or the prospectus or has neglected its duties and caused damage to the shareholders, the asset manager is liable for such damages.

  • If the asset manager is liable for damages, any related director or auditor (including members of the audit committee) to whom the damage is attributable is jointly liable for damages.

  • If the asset manager, the trustee, the Authorized Participant or the distributor are

liable for damages to the shareholders pursuant to the law, they are jointly liable.

  • 5.

    Jurisdiction

    • Any suit filed by the asset manager, the trustee, the distributor, or the Authorized Participant must be submitted to the court having jurisdiction over the place of the head office of the party filing suit.

  • Any suit filed by a shareholder must be submitted either to the court having jurisdiction over the shareholder’s domicile or the court having jurisdiction over the place of the office of the asset manager, the distributor, or the Authorized Participant doing business with the shareholder, according to the shareholder’s choice, provided that, if the shareholder is a non-resident within the meaning of Article 3(1)(xiii) of the Foreign Exchange Transaction Act, the suit must be submitted to the court having jurisdiction over the place of office of the asset manager, the trustee, the distributor, or the Authorized Participant.

      Other Matters re Protection of Shareholders

  • Anyone wishing to obtain the trust deed or more information on this Fund may request information from the asset manager, the Authorized Participant or the distributor any time.

  • Information on changes in the net asset value per share or investment performance can be obtained anytime from the asset manager, the Authorized
