RESOLUTION TO DECERTIFY PART OF PADGETT ROAD (.30 MILES)

Commissioner Ogden moved to adopt the following RESOLUTION, seconded by Commissioner Saunders.

WHEREAS, the Charlevoix County Road Commission has jurisdiction of Padgett Road in Melrose Township;

AND WHEREAS, the Road Commission has analyzed public transportation requirements, and the following seasonal part of Padgett Road has an unstable surface consisting of wet natural earth soil which is not maintainable to provide convenient travel for normal vehicular traffic, and the subject road portion does not provide access to any dwellings; therefore, this Board determines it is in the best public interest to decertify the following part of Padgett Road:

Starting at the seasonal road sign and barricade on Padgett Road (both located .43 miles south of E. Bear River Road in Sections 1 & 2, Melrose Township, and continuing a distance of .30 miles south through the swamp to high ground and hardwoods which is the end of the decertified part, also barricaded).

THEREFORE, BE IT RESOLVED, this Board decertifies the above described road portion from the county road system effective Monday, November 28, 2005.  This action to decertify does not imply any relinquishment of right-of-way; the Charlevoix County Road Commission hereby states that any and all right-of-way within the decertified road portion shall be retained for Road Commission use.

BE IT FURTHER RESOLVED, the Charlevoix County Road Commission Clerk shall provide Resolution copy to the Charlevoix County Register of Deeds, to the proper highway authorities, and to the Melrose Township Supervisor and Clerk.

Resolution adopted by the following vote:

YEAS:Saunders, Way, Ogden

NAYS:None.

I certify this to be a true RESOLUTION copy made and adopted at the Charlevoix County Board of Road Commissioners November 28, 2005 regular meeting.

________________________________

Shelley Kondrat, Clerk

NOTE:  For further background information regarding Padgett Road decertification, see November 14, 2005 CCRC Meeting Minutes, Page 2, lines 57 through 63.

Mr. Harmon:

Informed all present CCRC has been selected to receive a 2005 Asphalt Pavement Association of Michigan-MDOT Asphalt Paving Award of Excellence for Thumb Lake Road Project, along with H&D, Inc. and Northwest Design Group.  Mr. Harmon and Mr. Vanek will attend the banquet and accept the recognition plaque.

Said new Ford pickup truck and two new Peterbilt single-axle trucks are here.  He explained the Peterbilt trucks are complete other than the automatic greasers, which must be in stalled installed at their Wisconsin factory.  Peterbilt will pick-up pick up the trucks, install the greasers and delivery them back to CCRC Boyne City garage within 3-5 days.  The Board would like them installed as soon as possible.

Said the Charlevoix County Board rescinded their “No Smoking Policy” and recommended CCRC will do the same.

Commissioner Ogden moved to rescind Policy #2005-2 entitled “No Smoking Policy” implemented July 25, 2005, seconded by Commissioner Saunders.

VOTE:Ayes – 3Nays – 0Motion carried.

Mrs. Kondrat cited the low general fund balance; adding MDOT annual snow check and October 2005 MTF check will arrive in early December.  She suggested borrowing $124,740 (Sutliff Pit manufactured gravel expense) from another fund if required to pay bills.
