the earliest possible opportunity but in any event within 48 hour of such change or acquisition.

13.8 Notices

All notices to be given under this agreement shall be in writing and shall either be delivered personally or sent by first class or airmail, prepaid post or email and shall be deemed duly served:

13.8.1 in the case of a notice delivered personally, at the time of delivery

13.8.2 in the case of a notice sent inland by first class prepaid post and emails, 3 clear business days after the date of dispatch

13.8.3 in the case of a notice sent overseas by airmail, 10 business days (being business days in the place to     which the notice is dispatched) after the date of dispatch: and

Each notice shall be addressed to the address of the party concerned set out in this agreement or to such other address as that party shall have previously notified to the sender.

13.9 Connections right to assign

This agreement and all rights under it may be assigned or transferred by Connections.

13.10 Proper law and jurisdiction

13.10.1 This agreement shall be governed by English law in every particular including formation and interpretation and shall be deemed to have been made in England.

13.10.2 Any proceedings arising out of or in connection with this agreement may be bought in any court of competent jurisdiction in England and Wales.

13.10.3 The submission by the parties to such jurisdiction shall not limit the right of Connections to commence any proceedings arising out to this agreement in any other jurisdiction it may consider appropriate.

13.10.4 Any notice of proceedings or other notices in connection was or which would give effect to any such proceedings may without prejudice to any other method of service be served on any party in accordance with clause 13.8.

13.10.5 The client's address for service shall be the address for such service nominated at the head of this agreement and any time limits in any proceedings shall not be extended by virtue only of the foreign residence of the client.

13.11 Survival of terms

No term shall survive expiry or termination of this agreement unless expressly provided.

13.12 Parent’s Undertaking in respect of Homestay

In the event that it comes to Connections attention that the clients have entered into direct arrangement with a homestay who were provided by Connections, without involving Connections, the client shall be liable to pay Connections fees as lf Connections had placed the student with the family under the terms of this agreement.

13.13 Waiver

The failure by either party to enforce at any time or for any period any one or more of the terms or conditions of this agreement shall not be a waiver of them or of the right at any time subsequently to enforce all terms and conditions of this agreement.

13.14 Costs

Each of the parties shall pay any costs and expenses incurred by it in connection with this agreement.

13.15 Third party rights

A person who is not a party to this agreement has no right under the Contracts (rights of Third Parties) Act 1999 to enforce any terms of this agreement.

13.16 Charges for acting in an emergency

Connections may (at its discretion) charge extra for acting in an Emergency. If Connections or its agents or employees spend more than 3 hours dealing with an emergency Connections shall charge an additional GBP150 per day.  The Client must also pay all additional expenses incurred during any emergency in relation to the wellbeing of the student.  The client is contracted to pay Connections immediately upon issue of invoice.

13.17 Charges

All Connections charges are subject to changes at any time at the discretion of Connections and signed on behalf of Connections.

13.18 Payments

At the time of application a payment of GBP500 minimum must be made to Connections.  The placement service cannot commence until such payments are received.  Payments may be made to Connections by bankers draft, in GBP sterling, by electronic transfer to Connections UK Guardianships Ltd HSBC bank account. Please contact Connections or the agent for further details. Please ensure that the student's name is always included on the transfer document, indicating the transfer is in respect of the Connections Guardianship service. Bank charges and commission for both the sending and receiving banks should be paid by the sender of the funds or they will be applied to the student’s account. 

13.19 Insurance

Connections recommends that the student obtains their own personal insurance, accident insurance and travel insurance to cover liabilities of students whilst travelling and whilst in the UK.

13.20 Private Fostering

All students under the age of sixteen years of age, who live with a family for more than twenty eight-days, are classified as being privately fostered under the terms of the Children’s Act. To conform to this Act we are legally obliged to inform the Department of Social Services of the County Council that a student is resident with the homestay. By signing this form, the client acknowledges that they have no objection to any necessary checks to be undertaken by the Department of Social Services and for Connections to pass on any requested information.

13.21 Data Protection

Any information provided to Connections may be held on computer and shall be used by Connections in accordance with its data protection registration and the data Protection principles.

13.22 Advance Warning

You may be aware that state schools are encouraged by the Government to charge up to GBP4000 per year for educating overseas students in years 12 and 13 (sixth form).  As yet, our EU students are not being charged in the schools with which we are working.  However, the school governing boards have the right to change this policy, and
