Legal claims in Martin appeal
DCF violated the due process clause of the Fourteenth Amendment when it failed to provide plaintiff with notice of her right to appeal the DCF’s May 2006 decision to deny her eligibility for voluntary services.
The reasonable efforts hearing held in December 2007 was insufficient to protect plaintiff’s right to pre-deprivation due process.
Plaintiff was entitled to a pre-deprivation hearing to assure the health and safety of her son pursuant to Conn. Gen. Stat. §17a-11(f) and the due process clause of the 14th Amendment.
