(c)  Not more than 120 days after admitting a child, the department shall petition the probate court for the district in which a parent or the youth resides for a determination as to whether continuation in care is in the child’s best interest, and, if so, whether there is an appropriate case service or permanency plan.

For children who are not in an out of home placement, DCF must provide a case service plan;

For those in out of home placement, in either a licensed foster home or other facility must have a permanency plan.

Probate court must schedule a hearing within 30 days of receipt of the application, unless continued for cause shown.

Probate court must give five days notice of hearing to DCF and parent or child

Court has continuing jurisdiction in proceedings.
