13.4

Land Bank reserves the right to; cancel/reject any tender and not to award the tender to the lowest tender or award parts of the tender to different tenderers, or not to award the tender at all.

13.5

Land Bank reserves the right to publish, or otherwise make known all such questions/ inquiries and the related answers to all tenderers who have been invited to tender and who are contemplating submitting response to this tender request.

13.6

In the case of a consortium each of the authorised enterprise’s members must sign the reply to this            RFP. In the case of a joint venture all partners of the different enterprises must co-sign the reply to this RFP.

13.7

No interest shall be payable on accounts due to the successful tender in an event of a dispute arising on any stipulation in the contract until such time that the dispute is resolved to the satisfaction of the Land Bank and the successful tenderer.

13.8

Tenderers must ensure that under no circumstances are the warranty conditions set by the             manufacture of the parts( to be installed in case of a repair) violated.

13.9

Tender forms should not be retyped or redrafted, but photocopies may be prepared and used.

13.10

Should tender forms not be filled in by means of mechanical devices, for example typewriters or                

             PC’s, Ink (preferably black) must be used to complete tenders.

13.11

All documents requiring signatures must be done so in INK. Forms with photocopied or with other               

             forms of  reproduced signatures will be rejected.

13.12

Tenderers are responsible to ensure that they submit a complete response.  No liability will be           accepted in  regard to claims arising from the fact that pages or sections are mission or duplicated.

13.13

A service provider may not recruit or shall not attempt to recruit an employee of the principal (i.e.           Land Bank) for the purposes of preparation of the bid or for the duration of the execution of this          contract or any part  thereof.

13.14

All prices should be quoted in South African Currency.

13.15

All returnable schedules should be returned fully completed as information therein will be used in the adjudication of this tender, failure may invalidate a tender.

13.16

The tender shall be held irrevocable for acceptance by Land Bank for a period of 90 working days            from close of tender.
