decrease resulting from the change, imposition, or abolition of customs or excise duty and any other duty, levy, or tax which, in terms of a law or regulation is binding on the contractor and demonstrably has an influence on the price of any supplies, or the rendering cost of any service, for the execution of a contract.

1.9

Goods – means any work, services, materials or anything of whatever nature to be rendered to Land Bank or Land Bank’s delegate by the successful tenderers in terms of the tender.

1.10

Historically Disadvantaged Individual (HDI) - means a South African citizen:

Who, due to the apartheid policy that had been in place, had no franchise in national elections prior to the introduction of the Constitution of the Republic of South Africa, 1983, (Act 110 of 1983) or the Constitution of the Republic of South Africa, 1993 (Act 200 of 1993) (the Interim Constitution); and/or.

Who is a female; and/or

Who has a disability

Provided that, a person who obtained South African citizenship on or after the coming to effect of the Interim Constitution is deemed not to be an HDI.

1.11

Non-firm price (s) - means a price (s) other than “firm” price (s).

1.12

Person (s) - refers to a natural and/or juristic person (s).

1.13

Rand value - means the total estimated value in Rand denomination, which is calculated at the time of tender invitations and includes all applicable taxes and excise duties.

1.14

Sub-Contracting - means the contracting, assigning or leasing or making out work to, or employing, another person to support the prime tenderer/contractor in the execution of part of a project under tender in terms of a written contract between the two parties.

1.15

Tenderer - means any person/s constituted as, partnership, company, close corporation, or any other form of enterprise which has been invited by Land Bank to submit a tender in response to the Request or tender and which is referred to herein as “tenderer” or “you”.
