DECISION OF DIRECTOR OF LIQUOR LICENSING
WOOLWORTHS LIQUOR - CARRAMAR
WOOLWORTH SUPERMARKET, CNR JOONDALUP AND CHERITON DRIVES, CARRAMAR
NATURE OF MATTER:
CONDITIONAL GRANT OF A LIQUOR STORE LICENCE
This is an application by Woolworths Limited ("the applicant") for the conditional grant of a liquor store licence for premises to be known as Woolworths Liquor - Carramar and situated at Woolworths Supermarket, Cnr Joondalup and Cheriton Drives, Carramar. The application is made pursuant to Sections 47 and 62 of the Liquor Control Act 1988 ("the Act").
Pursuant to section 67 of the Act, the application was advertised on the site of the premises between the dates of 7 May 2008 and 3 June 2008; by way of a Notice published in The West Australian newspaper on 7 May 2008; and by way of a Notice to Residents and Businesses, distributed within a 200 metre radius of the premises. No objections were lodged against the application.
Pursuant to section 38 of the Act, the applicant is required to satisfy the licensing authority that the granting of the application is in the public interest. The matters to which the licensing authority may have regard to when considering the public interest are set out in section 38(4) of the Act.
In this respect, section 38(2) of the Act places an onus on the applicant to satisfy the licensing authority that the grant of the application is in the public interest.
Pursuant to sections 13 and 16 of the Act, I have decided to determine this application on the written submissions of the applicant.
MERITS OF THE APPLICATION
In order to discharge the onus on the applicant under section 38(2), a Public Interest Assessment (PIA) was lodged by the applicant on 17 April 2008. The PIA is summarised below.
The premises will be a modern, purpose built liquor store, forming part of the new Woolworths Supermarket. It will be constructed and fitted out in accordance with the new Applicant’s standard corporate specifications and livery.
The total floor space will be approximately 186.1m2. Of this, approximately 150m2 will be trading area, 28.9m2 will be cool room and 7m2 storage.
