  • The premises will be located in a shopping centre. Any sound or disturbance arising

from the operation of the premises is in keeping with its surrounds. These aspects were assessed by the Local Authority when the Development Approval was granted to establish the shopping centre at the site;

  • The premises is not located in a known ‘hotspot’ or bunched with other licensed

premises;

  • The applicant has a well-established track record of managing licensed premises

responsibly and appropriately. The applicant will put in place regular policies and procedures (which are best practice and in place at the applicant’s other licensed premises throughout Australia) to ensure that the risk of offence, annoyance, disturbance or inconvenience due to the premises is minimised;

  • The liquor store is located within the supermarket, within the shopping centre, with no

external after hours trading access. This will increase the security and safety aspects of the premises.

Summary

There is a requirement for the premises, demonstrated by the following points:

  • With a current population for the locality of over 15,000 people, and an expected

doubling of the population in the area which will be serviced by the premises between 2006 and 2011, there is, and will continue to be, a growing demand for packaged liquor services in the area;

  • Market research and trade figures of the applicant indicate that ‘convenience’ liquor

stores, such as the premises, account for 71% of consumer demand;

  • It is unreasonable for residents in the locality and, for that matter, the Urban Wedge

where 85% of the locality’s population resides, to expect to have a packaged liquor outlet, such as the premises, in their local area;

  • Being located on Joondalup Drive, a main arterial road for the locality, the premises is

easily accessible to residents and visitors of the locality. Significant parking is available on site;

  • The closest packaged liquor outlet to the premises is the Bottle-O Candlewood Liquor

Store and situated at The Candlewood Village Shopping Centre, Joondalup, approximately 3km west of the premises. This is inconvenient to the majority of the locality’s population;
