requirements, which is inconvenient and time-consuming; and

4) They all want to be able to purchase their weekly necessities, including packaged liquor, at the one place location close to their homes.

  • No adverse response to the application was received from consultations with the City

of Wanneroo, the City of Joondalup, the WA Police Alcohol and Drugs Unit or the local police and the schools closest to the premises;

  • Currently there is only one existing packaged liquor facility in the locality, the Bottle-O

Candlewood Liquor store. This licence was granted in 1994, when just over 2505 people resided in the locality. There are now just over 15,000 people residing in the locality;

  • One facility providing packaged liquor facilities is inadequate for the current

population, let alone the projected, increased population. This facility is inconvenient to access and fails to adequately meet the packaged liquor needs for many residents of the locality;

  • A sample of residents of the locality confirmed that the residents require a packaged

liquor outlet that is convenient to them and located where they could complete their weekly and monthly household shopping at the same time.

DETERMINATION

I am satisfied, on the balance of probabilities, that pursuant to sections 33 and 38(2) of the Act, the grant of the application is in the public interest.

The profit sharing arrangement between the applicant and Peet Limited contained in the lease dated 17 April 2008 is approved.

This licence is conditionally granted and is subject to the following conditions:-

  • a Certificate under section 39 of the Act being lodged before the operation of the licence;

  • compliance with the Local Government Act 1960, Health Act 1911 and any written law relating to the sewerage and drainage of these premises;
