  • (c)

    The Plan Sponsor will not use or disclose protected health information for employment- related actions or decisions or in connection with any other benefit or employee benefit plan of the Plan Sponsor.

  • (d)

    The Plan Sponsor will report to the Plan any use or disclosure of protected health information that is inconsistent with the uses and disclosures allowed under the Plan Document of which it becomes aware.

  • (e)

    The Plan Sponsor will make any protected health information solely available to it available in accordance with 45 Code of Federal Regulations § 164.524.

  • (f)

    The Plan Sponsor will make protected health information solely available to it for amendment in accordance with 45 Code of Federal Regulations § 164.526.

  • (g)

    The Plan Sponsor will track disclosures it may make of protected health information solely available to it so that it can make available the information required for the Plan or its business associates to provide an accounting of disclosures in accordance with 45 Code of Federal Regulations § 164.528.

  • (h)

    The Plan Sponsor will make available its internal practices, books, and records, relating to its use and disclosure of protected health information, if any, to the U.S. Department of Health and Human Services to determine compliance with 45 Code of Federal Regulations Parts 160-64.

(i) The Plan Sponsor will, if feasible, return or destroy all protected health information in any form received from the Plan, when protected health information is no longer needed for the Plan administration purposes for which the disclosure was made. If it is not feasible to return or destroy all such protected health information, the Plan Sponsor will limit the use or disclosure of any protected health information it cannot feasibly return or destroy to those purposes that make the return or destruction of the information infeasible.

The following employees or classes of employees or other workforce members under the control of the Plan Sponsor may be given access to protected health information received from the Plan or a health insurance issuer or business associate servicing the Plan:

Employees of the Department of Finance and Administration, Office of Insurance.

  • (a)

    This list includes every employee or class of employees or other workforce members under the control of the Plan Sponsor who may receive protected health information relating to payment under, health care operations of, or other matters pertaining to the Plan in the ordinary course of business.

  • (b)

    The employees, classes of employees, or other workforce members identified above will have access to protected health information only to perform the Plan administration functions that the Plan Sponsor provides for the Plan.
