Request submitted by Polsinelli, Shalton, Flanigan, Suelthaus for Robert and Leslee Johnson, owners.
Deputy Planning Director Allmon explained that the applicant requests special use permit approval to allow an equipment rental business to operate in conformance with the SPMCHO (Shawnee Mission Parkway Commercial Highway Overlay) zoning district at 11330 Shawnee Mission Parkway. The application is filed by Polsinelli, Shalton, Flanigan and Suelthaus for Robert and Leslee Johnson, property owners.
SITE PLAN REVIEW
The applicant requests approval of a special use permit to eliminate the legal non-conforming use status of an existing business, located at 11330 Shawnee Mission Parkway. The property is zoned SMPCHO (Shawnee Mission Parkway Commercial Highway Overlay). Properties to the north, south, and east are also zoned SMPCHO. The property sits at the western limit of the overlay district so that property directly to the west is zoned CH (Commercial Highway). Two legal, non-conforming homes that are also owned by the Johnsons are located to the north of the business. An office building is located to the west, while a quick oil change facility is located to the east. Right-of-way for Shawnee Mission Parkway is located to the south.
The Arrow Rents equipment rental business has operated at the site since 1971, with the Johnsons obtaining ownership in 1985. The business operated legally and in zoning compliance with the CH zoning regulations until 2002 when the Commercial Highway overlay district was created.
