required before parties may file suit in court; (6) explicitly or implicitly defines key terms; and

(7) addresses other important issues affecting clarity and general draftsmanship of regulations.

NHTSA has reviewed this rule according to the general requirements and the specific

requirements for regulations set forth in Executive Order 12988. This rule does not result in any

preemptive effect and does not have a retroactive effect. A petition for reconsideration or other

administrative proceeding is not required before parties may file suit in court.

Paperwork Reduction Act

Under the Paperwork Reduction Act of 1995 (PRA), a person is not required to respond

to a collection of information by a Federal agency unless the collection displays a valid OMB

control number. The Consolidated VIN Requirements have an OMB control number of 2127-

0510. Although the agency may require information to be provided in a slightly different way as

a result of this final rule (e.g., vehicle make being transferred from the first to the second section

of the VIN), the scope of the overall reporting requirements of Part 565 will not change. We

emphasize that there will be no increase or decrease in the collection of information because of

this rulemaking.

Plain Language

Executive Order 12866 and the President's memorandum of June 1, 1998, require each

agency to write all rules in plain language. Application of the principles of plain language

includes consideration of the following questions:

  • Have we organized the material to suit the public's needs?

  • Are the requirements in the rule clearly stated?

  • Does the rule contain technical language or jargon that isn't clear?
