development in Drawing Nos. PL-100/B, -101/D, -103/L, -104/K, -105/H, -106/J, -107/L, -108/K, -110/C, -111/B, -112/C, -113/C, -114/C, -115, -116/F, /117/D, -119/D, -120/C, -150/C, PL/152 and L/00/01C, TP31 - 36, TP37/A, TP38 and TP39 subject to the following conditions:-

The development shall be carried out in accordance with a phasing programme to be approved in writing by the Local Planning Authority and the development shall not be carried out other than in accordance with this programme.

REASON: To ensure a satisfactory form and sequence of development is achieved in accordance with adopted UDP policy B1 & P2 and RUDP policy 4.1 & 1.10.

Noise mitigation measures set out in paragraphs 6.51 – 6.61 (p.36-37) of the EIA and details of mitigation measures in respect of air quality as contained in the EIA, shall be provided in accordance with the details so approved, before of any part of the development is occupied and retained permanently with regular maintenance of the proposed equipment.

REASON: To ensure that this essential aspect of the development is carried out prior to the use or occupation of any part of the development to secure a satisfactory living environment in accordance with adopted and replacement UDP policies B8 and 4.11.

Samples of the materials to be used for the external surfaces of the development including:- (i) The new 3-storey blocks of flats to the north of the site; (ii) The new terrace of flats in Third Avenue; (iii) The proposed roof extension and to Bromyard House; (iv) The new entrances to Bromyard House; (v) Surface finishes to childrens’ play area, cycle storage areas, car parking and accesses; shall be submitted to and approved in writing by the Local Planning Authority before any part of the development is commenced, and this condition shall apply notwithstanding any indications as to these matters which have been given in this application. Development shall be carried out in accordance with the approved details.

REASON: To ensure that the materials harmonise with the surroundings, in accordance with adopted UDP policies B1 and B5 and RUDP policy 4.1.

For each phase identified pursuant to condition no. 2 no development shall take place until full details of both hard and soft landscape works, including a phased programme of works and an accurate tree survey indicating condition, size and spread etc. for whole site and spread of trees from Bromyard Ave etc, indicating which trees are to be retained and which removed, have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved prior to the occupation of any phase of the development or in accordance with the programme agreed by the Local Planning Authority. Any trees or other plants which die or are removed within the first five years following the implementation of the landscaping scheme shall be replaced during the next planting season.

REASON: To ensure that the development is landscaped in the interests of the visual character and appearance of the area in accordance with adopted UDP policies B2 and ES4 and RUDP policy 4.5.

Prior to the occupation of the relevant phase of the development a schedule of landscape maintenance for a minimum period of 5 years has been submitted to and approved in writing by the Local Planning Authority. The schedule shall include details for the arrangement of its implementation. Landscape maintenance shall be carried out in accordance with the approved schedule.

REASON: To protect the landscaping in the interests of the visual character and appearance of the area in accordance with adopted UDP policies B2, ES4 and RUDP policies 4.5.
