Applicant - By submitting this application I understand the following conditions apply:

1.

Plantings / improvements shall not interfere with the engineering drainage or public health.

2.

Any improvements done within an owners unit or on the properties outside shall be subject to all existing State, County, Municipal and Association laws, ordinances and regulations.  All necessary permits will be obtained after application approval and before beginning such improvements.

3.

The Associations approval of plans does not preclude the applicants need to obtain a Village of Romeoville building permit.

4.

The applicant will be held responsible for any deviations from approved plans and will be required to make any necessary corrections at the applicant’s expense.

5.

The applicant understands that any improvements when completed, although forming a part of the properties, will not be the subject of any insurance coverage or any loss prevention or indemnification coverage by the Association.

6.

Applicant acknowledges that the responsibility to repair and maintain the improvement rests solely with the owner and does not become the responsibility of the association.

7.

Applicant also acknowledges that the Association has the right to remove any improvements that are not properly maintained.

8.

Applicant acknowledges that the association can not be held responsible for accidental damage to plantings incurred during routine maintenance.

9.

Applicant acknowledges that easements for underground utilities have been identified by contacting J.U.L.I.E. ( 800-892-0123 ) Prior to the start of work, and further understands that placing permanent improvements on said easements are restricted.  Easements of record can be found on the Plat of Survey.

10.

Any improvements on easement right of ways may be subject to removal at the applicant’s expense, in the event that the utilities must gain access to the area.

11.

The applicant by execution and acceptance of this application, has remised, released and forever discharged the Association, the Board of Directors and the Developer and the Managing Agent of and from all obligations, controversies, suits actions causes of actions, trespasses, variances, damages claims or demands in law or equity, against the said Association, the Board of Directors and the Developer and the Managing Agent.
