5.2

Without prejudice to any other remedy available to the PCT under the terms of the Contract, where in the PCT’s opinion the Contractor has failed to meet any aspect of the quality standards required under Clause 5.1 or elsewhere in the Contract, the PCT may require an immediate meeting with the Contractor with a view to discussing the failure and agreeing appropriate corrective action to remedy such failure.

PART 6 LEVEL OF SKILL

6.1

Without prejudice to the Contractor’s obligations to meet all performance requirements under the Contract, the Contractor shall carry out its obligations under the Contract in a timely manner and using a high degree of care and skill.10

PROVISION OF SERVICES

Premises

6.2

The address of [each of] the premises to be used by the Contractor[or any sub-contractor] for the provision of services under the Contract shall be detailed in Section 3 (Specification).

6.3

Subject to any remedial action which is included in the Contract pursuant to Clause 6.411 for bringing the premises up to the required standard, the Contractor shall ensure that premises used for the provision of services under the Contract are in all ways:

6.3.1

suitable for the delivery of those services; and

6.3.2

sufficient to meet the reasonable needs of the Contractor’s patients.

6.4

Where, on the date on which the Contract is signed, the PCT is not satisfied that all or any of the premises specified in Clause 6.2 meet the requirements set out in Clause 6.3 , the PCT and the Contractor shall together draw up remedial action, which shall be attached as Schedule 2 to this Section 2 (General Conditions of Contract) of the Contract, which specifies:
