6.9

The Contractor shall ensure that it has appropriate arrangements for infection control and decontamination.

PART 7 PERSONS WHO SHALL PERFORM THE SERVICES

Qualifications of Performers15

7.1

Subject to Clause 7.2, no medical practitioner shall perform primary medical services under the Contract unless he is:

7.1.1

included in a Medical Performers List for a Primary Care Trust in England;

7.1.2

not suspended from that list or from the Medical Register; and

7.1.3

not subject to interim suspension under section 41A of the Medical Act 1983.

7.2

Clause 7.1 shall not apply in the case of:

7.2.1

a person who is provisionally registered under section 15, 15A or 21 of the Medical Act 1983 acting in the course of his employment in a resident medical capacity in an approved medical practice; or

7.2.2

a GP Registrar during the first two (2) months of his training period.

7.3

No Health Care Professional other than one to whom Clauses 7.1 and 7.2 apply shall perform clinical services under the Contract unless he is registered with his relevant professional body and his registration is not currently suspended.

7.4

Where the registration of a Health Care Professional or, in the case of a medical practitioner, his inclusion in a Primary Care List is subject to conditions, the Contractor shall ensure compliance with those conditions insofar as they are relevant to the Contract.
