are given to any of the persons specified in Clause 21.2 by, or on behalf of, a Patient, a relative of a Patient or any person who provides or wishes to provide services to the Contractor or its Patients in connection with the Contract; and
have, in its reasonable opinion, a value of more than £100.00.
The persons referred to in Clause 21.1 are:
any person employed by the Contractor for the purposes of the Contract;
any General Medical Practitioner engaged by the Contractor for the purposes of the Contract;
if the Contractor is a company, any directors or company secretary of the company;70
if the Contractor is an Industrial and Provident Society, Friendly Society, Voluntary Organisation as defined in the NHS Act 1977 or other body any officer, trustee or any other person concerned with the management of the Contractor;71
any spouse of a person specified in Clauses 21.2.1 to 21.2.2; or
any person (whether or not of the opposite sex) whose relationship with a person specified in Clauses 21.2.3 to 21.2.2 has the characteristics of the relationship between husband and wife.
Clause 21.1 does not apply where:
there are reasonable grounds for believing that the gift is unconnected with services provided or to be provided by the Contractor;
the Contractor is not aware of the gift; or
the Contractor is not aware that the donor wishes to provide services to the Contractor.
