21.4

The Contractor shall take reasonable steps to ensure that it is informed of gifts which fall within Clause 21.1 and which are given to the persons specified in Clauses 21.2.3 to 21.2.7.

21.5

The register referred to in Clause 21.1 shall include the following information:

21.5.1

the name of the donor;

21.5.2

in a case where the donor is a Patient, the Patient’s National Health Service number or, if the number is not known, his address;

21.5.3

in any other case, the address of the donor;

21.5.4

the nature of the gift;

21.5.5

the estimated value of the gift; and

21.5.6

the name of the person or persons who received the gift.

21.6

The Contractor shall make the register available to the PCT on request.

PART 22 COMPLIANCE WITH LEGISLATION AND GUIDANCE72

22.1

The Contractor shall comply with all relevant legislation and have regard to all relevant guidance issued by the PCT, the Relevant Strategic Health Authority or the Secretary of State.

PART 23 OTHER PROVISIONS

NON-SURVIVAL OF TERMS

23.1

Unless expressly provided, no term of the Contract shall survive expiry or termination of the Contract. Express provision is made in relation to:

23.1.1

Clause 10.26 to 10.29 (Counter Fraud and Security Management);

23.1.2

PART 12 (Fees and Charges);

23.1.3

PART 14 (Insurance);

23.1.4

PART 15 (Complaints);
