ANNEX TO THE OPERATIONAL MATTERS AND EXERCISE PLANNING
REGARDING COMMAND AND FUNCTIONAL RELATIONSHIPS
Pursuant to Articles IV and VII of the “Agreement between the Government of the Republic of Bulgaria and the Government of the United States of America on Defense Cooperation”, signed in Sofia on April 28, 2006 (hereinafter “the Agreement”), it is agreed as follows:
1.The Bulgarian and United States commanders at each installation shall work together and coordinate their activities to ensure a secure environment and effective training of the forces.
2.The agreed areas and facilities shall be under the command of the Bulgarian Armed Forces. The Bulgarian installation commander has full command authority over all Bulgarian military personnel and equipment assigned to the installation. The Bulgarian commander is responsible for the maintenance of discipline over Bulgarian personnel. In the exercise of his command authority, the Bulgarian installation commander shall not affect the freedom of action of United States forces, within the agreed facilities and areas, and shall not create impediments to the execution of their operational duties. Nothing in this Implementing Arrangement shall create impediments to the Bulgarian Armed Forces to execute their duties, as derived from the Constitution of the Republic of Bulgaria.
3.The United States commander has full command authority over United States forces, equipment, and operations on or operating from the installation. The United States commander shall be responsible for the maintenance of discipline over the members of the United States force.
4.The Bulgarian installation commander and senior United States commander shall coordinate their efforts to provide an effective execution of training plans, according to the Aerial and Land Training Annexes. The senior United States commander shall consult with the Bulgarian installation commander regarding any proposed changes to the training plans.
5.In order to maximize training results, the Bulgarian and United States commanders may organize bi-lateral training. In this case the two commanders shall:
Develop Special Instructions (SPINS);
Develop mutual scheduling and smooth coordination of the training events;
Develop and implement safety rules.
6.All security matters shall be resolved in accordance with the Security Implementing Arrangement.
7.The Bulgarian installation commander and the senior United States commander shall resolve in a spirit of mutual trust and cooperation any problems regarding the application of the provisions contained in the Agreement and this Annex. If command channels are unable to resolve issues, the issues may be presented to the Joint Commission for resolution.
