RECOMMENDED COUNCIL ACTION:

By motion, introduce Ordinance No. 10-2202 for first reading and direct that it be placed on file for second reading at the April 15, 2010 Council meeting.

SCHEDULE OF ACTIONS:

Public and written notice has been provided as required by City Charter. The vacation of drainage and utility easements is being requested for the replatting of the lots with the plat of Crescent Ponds 6th Addition. A similar request was processed last year by Pulte for lots along 122nd Avenue, and is a result of the merger of Pulte Homes with Centex Homes in 2009. The applicant is a single property owner who represents 100% of the affected property abutting this easement. Replacement easements will be dedicated with the new plat. The Engineering Department has reviewed the request and concurs with the vacation.
