I.

Erosion Control means the prevention or reduction or the detachment or movement of soil or rock fragments by water, wind, ice or gravity.

J.

Freshwater Wetland has the same meaning as Vegetated Wetland.

K.

Impermeable means having a hydraulic conductivity of less than .0002m/day.

L.

Impervious means a surface which does not allow water or other liquids to infiltrate into soil or groundwater

M.

Interest means the wetland interests (collectively, the interests protected by this Ordinance), specified in Section I(B)(1) of these regulations.

N.

Issuing authority means the Conservation Commission.

O.

Land under Water Bodies means the bottom of land under the surface of any lake, river, pond, or perennial or intermittent stream.  In the case of an intermittent stream, it shall be the area under the stream, when flowing at its mean annual flow.

P.

Non-transient macro-organisms means wetland plants and/or animals visible to the naked eye, including but not limited to Eubrachiopods, Isopods, Amphipods, Pisidiid clams.

Q.

Obstructions or Objects in Water mean, but are not limited to, dams, weirs, sluice gates, breakwaters, piers, docks, bulkheads, pilings, slips, and floats.

R.

Ordinance means the Holyoke Wetlands Protection Ordinance.

S.

Permit means the document issued by the Commission containing conditions which regulate or prohibit an activity under the City of Holyoke Wetlands Protection Ordinance.  The Commission, in an appropriate case, may combine the Permit or other action on an Application issued under the Ordinance with the Order of Conditions issued under the Act.

T.

Permeable means having a hydraulic conductivity of .0002 m/day or more.

U.

Pervious means a surface which allows water or other liquids to infiltrate into the soil or groundwater.

V.

Pond means any open body of fresh water with a surface area observed or recorded within the past ten (10) years of at least 10,000 square feet, either naturally occurring or man made which has standing water due to natural causes at least once each year.  Basins or lagoons which are part of waste water treatment plants shall not be considered pond, nor shall swimming pools, or other man made impervious retention or detention basins.

W.

Protection of Fisheries means protection of the capacity of an Area Subject to Protection under the Ordinance to:

1.

Prevent or reduce contamination or damage to fish; and

2.

Serve as their habitat and nutrient source.

X.

Resource Area is synonymous with Area Subject to Protection under the Ordinance each of which is enumerated d in Section I(C)(1) of this Ordinance.

Y.

River shall have the same definition as that found in the Massachusetts Rivers Protection Act.
